This Privacy Policy governs how Big Beautiful Dream, LLC, d/b/a Va Beau (“Va Beau”, “we”, “us”, or “our”) collects, uses, maintains, and discloses information collected from users (each, a “User”, “you” or “your”) of our platform https://vabeau.com, as well as any affiliated websites, including mobile websites or applications, related, linked, owned, operated or otherwise controlled by Big Beautiful Dream, LLC (collectively, the “Platform”). 

Va Beau is committed to protecting your privacy. Please read our Privacy Policy carefully to better understand how we collect, use, protect, or otherwise handle your personal information. 

This Privacy Policy is intended to inform you of our policies regarding the collection, use, and disclosure your personal information when you use our Platform and the choices you have associated with that data. We use your data to provide and improve our Platform.

Both personal and non-personal data and information collected is safeguarded according to the highest privacy and data protection standards adopted worldwide. Specifically, for US residents, this Privacy Policy is intended to comply with the California Consumer Privacy Act 2018 (CCPA). For users in Europe, we also intend to comply with the General Data Protection Regulation of 2018 (GDPR), (EU) 2016/679. 

By using our Platform, you agree to the collection and use of your personal information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms.

1. Changes to this Privacy Policy


We reserve the right to change this Privacy Policy. We will notify you when material updates are made to give you an opportunity to withdraw previously given consent or to deny further use of your data. We may have to update this Privacy Policy in case of new developments, activities, online services or when applicable legislation changes. 

2. What Personal Information Do We Collect?

We collect personal information you voluntarily provide to us when you express an interest in obtaining information about us or our services, when you participate in activities on our website, use our Platform, or otherwise when you contact us.

The personal information we collect depends on the context of your interactions with us and our Platform, the choices you make, and the Platform features you use. 

“Personal Information” means information that can be used to identify you as an individual, such as:

* Personal data – personal information such as your name, profile picture, email, mailing addresses, and phone number.

* Registration data – such as information you provide to register for an account on our Platform or sign up to use our services, including your date of birth.

* Profile data – such as your username and password for your account with us, as well as your interests and preferences.

* Marketing data – such as the email address or contact details we use to send marketing communications and your preferences for receiving communications about our activities, events, and promotions.

* Purchase data – including your order history and information needed to process and fulfill your orders, including order details, billing address, and delivery address. 

* Travel Documentation – information to support travel and planning, including identity verification documents.

* Service provider information – information about the mobile or internet service provider you are using with your device to access our Platform, including name and IP address.

* Messages – the date, time, and content of any messages you send to us.

* Social media – information you have provided to third party companies to log into social media platforms. This includes publicly available information, such as name, age range and email addresses.

* Interactive features – personal information you submit or provide through our interactive features (e.g., messaging and chat features, commenting functionalities, forums, blogs, and social media pages). This may include photos, reviews, social posts, and videos. Any information you provide on the public sections of these features will be considered “public,” unless otherwise required by applicable law, and is not subject to the privacy protections of this policy. Please exercise caution before revealing any information that may identify you in the real world to other users. 

* Other information we may collect which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection.


Payments. Our Platform uses third-party services for payment processing (e.g., payment processors).

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their own privacy policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

Information We Receive from Other Sources. Sometimes we receive your information from third parties (other individuals, marketing services, our payment processors, and other third-party integrations), which may include:

* Information processed from third-party integrations you set up with us. For example, a third-party integration may give us access to information stored in that third party so we may facilitate the integration.

* Name, email, and business contact information.

* Information about you provided to us from other individuals or users of our Platform.


Location Information. We may also collect certain location information if you have instructed your device to send information via the privacy settings on that device, or, for example, if you have uploaded photos tagged with location information.

Information About Others. We may also collect, where you have provided it, information about other Travelers, including their email address and other travel-related information. If you are sharing information with us about other individuals, you must obtain their consent and make sure they understand and accept how we will use their personal information (as described in this Privacy Policy).

Passively Collected Information

Device and Usage Information. We automatically collect standard Google Analytics data when you visit, use, or navigate our Platform. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser, and device features, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Platform, and other technical information. This information is primarily used to maintain the security and operation of our Platform and is also used for our internal analytics and reporting purposes.

3. How Do We Use Your Information?


We use and collect your Personal Information for the following purposes:

For the Provision of Our Services. Va Beau uses your Personal information to (i) provide, operate and improve our services; (ii) provide information about our products and services; (iii) establish and maintain your user profile on our Platform; (iv) to process payments and fulfil orders for products or services placed by you, (v) enable security features of the Platform, such as sending you security codes, and remembering devices from which you have previously logged in; (vi) facilitate social features of the Platform, such as facilitating connections and providing chat functionalities; (vii) understand your needs and interests, and personalize your experience with the Platform. 

For Relationship Management and Marketing. Va Beau may use your Personal Information to send you newsletters, Va Beau-related marketing communications as permitted by law, and to otherwise update you on developments within Va Beau or affiliated entities. We also use your Personal Information for the development, execution and analysis of market research and marketing strategies. We may also analyze your use of our services to improve our Platform and develop new features, including by studying user demographics and use of the Platform. 

To Display Advertisements. We work with advertising partners to display advertisements on the Platform. These advertisements are delivered by our advertising partners and may be targeted based on your use of the Platform or your activity elsewhere online. 

To Provide Customer Support. We want to offer you the best experience possible when using our Platform. When you contact us, we will use your Personal Information to reply to you, answer your question, or handle your complaint. 

Improve our Services. We may use your Personal Information for analytical purposes and to enable us to improve our Platform and services, including to give you a tailored or optimized experience by grouping users based on, for example, usage, interests, and demographics.

Individualization and customization. We may notify you about special offers and services available from us, our affiliates, or our partners that may interest you. We may also use your information to tailor your experience, including by making inferences about your interests and preferences based on your activity, and customize the ads shown to you both on and off our Platform.

Communication. Va Beau uses your Personal information to (i) communicate with you or facilitate communication between you, our Suppliers, other Travelers, our partners, and/or affiliates; (ii) conduct, track and record your calls or interactions with us; for example, your communications with our customer service team, or through our use of pixels and similar technologies to track how you interact with our emails to you, such as whether you open or click on content in our emails; (iii) host your reviews, ratings, photos, videos and other content, and (iv) respond to your questions and comments.

To Post User Testimonials and Feedback. We often receive testimonials and comments from users who have had positive experiences with our Platform. We occasionally publish such content. When we publish this content, we will identify our users by their first and last name and may also show their home city. We obtain your consent before posting your name along with the testimonial. We may post user feedback on the Platform from time to time. We will share your feedback with your first name and last initial only. If we post your feedback, we will obtain your consent before posting your name with your feedback.

To Create Anonymous Data. We may create anonymous data from your Personal Information and other individuals whose personal information we collect. We turn Personal Information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve the Platform and promote our business.

To Comply with Applicable Law. We may use your Personal Information when needed to comply with applicable laws, lawful requests, and legal processes such as to respond to subpoenas or requests from government authorities. We may use your Personal Information and disclose it to law enforcement, government authorities, and private parties as we believe necessary or appropriate to: (i) protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (ii) enforce the terms that govern the Platform; and (iii) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity. Sometimes, we may specifically ask for your consent to collect, use, or share your Personal Information when required by law.

Additional Purposes. We may also use Personal Information you provide to us for other purposes as disclosed when you provide your Personal Information or otherwise with your consent.

4. How Do We Use Artificial Intelligence?


We may use artificial intelligence and machine learning for various purposes to deliver our Platform and associated services. We may use your Personal Information for the following purposes:

* To enhance your user experience and keep our Platform safe.

* To determine the sort order you see on our Platform.

* To provide destination, product, or activity recommendations.

* To provide price insights and alerts.

* To screen the content you upload on our Platform to ensure it meets our quality or formatting requirements.

* To screen the reviews you share with us to ensure they do not contain identifiable Personal Information or to assess customer satisfaction.

* To prevent and detect a breach of our Terms and Conditions or other fraudulent activities to keep our Platform safe.


Automated decisions may be made by putting your Personal Information into a system and the decision is calculated using automatic processes.

We will rely on our legitimate interest to keep our Platform safe and to enhance your user experience. We will not engage in automated decision-making that involves a decision with legal or similarly significant effects only based on automated processing of Personal Information, unless (i) you explicitly consented to the processing, (ii) the processing is necessary for entering into a contract or for its performance, or (iii) when otherwise allowed by applicable law.

You may have rights in relation to automated decision making, including the ability to ask for a manual decision-making to process instead, or to contest a decision based only on automated processing.

5. What Legal Bases Do We Have for Collecting Your Personal Information?


The legal basis we have for collecting and using your Personal Information will depend on the type of data collected and the specific context in which we collect it. In any case, it will be at least one of the following:

* We need to perform a contract with you

* You have given us consent 

* It is in our legitimate business interest and it’s not overridden by your rights

* For payment processing purposes

* To comply with our legal obligations


6. How Long Do We Retain Your Personal Information?


Your Personal Information will be kept by us for as long as necessary to serve the legitimate business purposes as set out above (for example, to provide you with a service you have requested). When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it or, if this is not possible, then we will securely store your Personal Information and isolate it from further processing until deletion is possible. We may need to retain Personal Information longer to comply with applicable laws, such as those relating to tax and accounting. 

7. When and With Whom Do We Share Your Information?


We may share your Personal Information with the following third parties and as otherwise described in this Privacy Policy or at the time of collection: 

Our Employees and Service Providers. Within Va Beau, our employees, contractors, agents, and directors have access to your Personal Information, but only to the extent necessary to properly perform their individual tasks. Other companies and individuals that provide services on our behalf or help us run our Platform or our business (such as payment processing, customer support, hosting, analytics, software development and maintenance, email delivery, marketing, database management services, and risk and fraud mitigation).

Experience Suppliers and Travelers. We may share Travelers’ Personal Information with Suppliers of experiences to enable them to fulfil the Bookings made through our Platform. We may also share Personal Information of experience Suppliers with Travelers, including but not limited to where there is a dispute between the two parties.

Payment Processors. For online payments and/or Automated Clearing House (ACH) payouts, we use the payment services of Shopify and Stripe. We do not process, record, or maintain your credit card or bank account information, but we will provide Shopify or Stripe with your payment information to enable them to process your payment for purchases on the Platform. Advertising Partners. When we use third-party cookies and other tracking tools, we may disclose your Personal Information to those third-party companies to help us analyze use of the Platform, display advertisements and advertise the Platform elsewhere online. 

Third-Party Platforms & Social Media. If you have enabled features or functionality that connect the Platform to a third-party platform or social media network (such as by logging in to the Platform using your account with the third-party, providing your API key or similar access token for the Platform to a third-party, or otherwise linking your account with the Platform to a third-party’s services), we may disclose the Personal Information that you authorized us to share. We do not control the third party’s use of your Personal Information.

Professionals. We may disclose your Personal Information to professional advisors, such as lawyers, bankers, auditors, and insurers, where necessary in the course of the professional services that they render to us.

Compliance. We may share your Personal Information for compliance, fraud prevention, and safety purposes. 

Business Transfers. We may sell, transfer, or otherwise share some or all our business or assets, including your Personal Information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution. In this case, we will make reasonable efforts to require the recipient to honor this Privacy Policy.

Affiliates. We may share your Personal Information with our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Policy.

Other Users of our Platform. We provide functionality that enables you to disclose Personal Information to other users of the Platform or the public. For example, you may maintain a user profile with information about yourself that you can provide to other users or the public. You may also submit content to the Platform (such as comments, reviews, surveys, blogs, photos, and videos), and we will display your name, username, and a link to your user profile along with the content you submit. We do not control how other users, or third parties, use any Personal Information you make available to other users or the public. Once you have posted information publicly, while you can still edit and delete it on our Platform, you cannot edit or delete this information if it is cached, collected, and stored elsewhere by others (e.g., search engines).

In all other cases, your Personal Information will not be given to third parties, unless required by law. Va Beau will never sell your Personal Information, unless as part of a business transfer and then only in accordance with applicable laws. 

8. What Are Your Targeted Online Advertising Opt-Out Options?


Users may opt out of receiving targeted advertising on websites through members of the Network Advertising Initiative by clicking here or the Digital Advertising Alliance by clicking here. European users may opt out of receiving targeted advertising on websites through members of the European Interactive Digital Advertising Alliance by clicking here, selecting the user’s country, and then clicking “Choices” (or similarly titled link). We also may work with companies that offer their own opt-out mechanisms and may not participate in the opt-out mechanisms linked above.

In addition, your mobile device settings may provide functionality to limit our, or our partners’, ability to engage in ad tracking or targeted advertising using the ‘advertising ID’ associated with your mobile device.

If you choose to opt-out of targeted advertisements, you will still see advertisements online, but they may not be relevant to you. Even if you choose to opt out, not all companies that serve online behavioral participate in these opt-out programs, so you may still receive some cookies and tailored advertisements from companies that are not listed.

9. What Are Your Other Information Choices?


In addition to your legal rights, our Platform provides you with certain options regarding the processing and use of your information by us. You can access, update, and even deactivate your account by visiting the “Profile” section on our Platform. In addition, you can:

* Choose the way we communicate with you.

* Choose not to give us certain information, although it may be needed to take advantage of certain features offered on our Platform.

* Prevent the collection of certain geolocation information (e.g. by switching off location services for our app in the settings of your phone), but note that turning off location sharing may affect certain features of our services.

* Deactivate your account directly from within your Profile. We may retain some information associated with your account (including past transactions) for internal purposes including backups, fraud prevention, dispute resolution, investigations, our own legitimate business interests, and legal compliance for the period necessary to fulfil the purposes outlined in this Privacy Policy.

* As a registered user, you can change your marketing preferences in the ‘Notifications’ section of your Profile.

* Unsubscribe from promotional messages, including emails with travel-related opportunities, in any email we send.


10. Transfer of Your Personal Information


While Va Beau operates globally, we are headquartered in the United States. Therefore, your Personal Information may be transferred to the United States or other locations outside of your state, province, or country where privacy laws may not be as protective as those in your state, province, or country. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. By using our Platform, you understand and consent to your information being transferred and processed as described in this Privacy Policy. 

11. Security


We value the protection of your privacy. We have implemented appropriate and reasonable technical and organizational security measures to protect your data from loss, misuse, unauthorized access, disclosure, alteration, or destruction. 

Despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties cannot defeat our security and improperly collect, access, steal, or change your information. 

Although we will do our best to protect your Personal Information, transmission of Personal Information to and from our Platform is at your own risk. Only access our Platform within an environment that you feel is appropriate and/or secure.

12. Your Rights (US Residents)


While the rights described in this section are based on the California Consumer Privacy Act, our policy is to provide all US residents with the below described rights. Therefore, as the owner of your Personal Information, you have these rights:

* Right of Access & Disclosure: You have the right to receive a copy of the Personal Information we hold about you to verify that we are lawfully processing the data. Specifically, you have the right to know:

* The categories of Personal Information we have collected about you during the past 12 months;

* The categories of sources from which the Personal Information was collected;

* The business or commercial purpose for collecting or selling your Personal Information;

* The categories of third parties with whom we share Personal Information; and

* The specific pieces of Personal Information we have collected about you.


Further, under California’s Shine the Light law, Va Beau users who are California residents may request a notice identifying the categories of Personal Information we share with third parties for our own direct marketing purposes.

* Right to Correction: You may request any incomplete or incorrect information we may have about you to be corrected or supplemented.


* Right to Delete: You have the right to ask us to delete your Personal Information. Once we receive and confirm your verifiable consumer request, we will delete your Personal Information from our records, unless certain exceptions apply.


* Right to Out-Out of Processing or Sharing: You can submit a request not to process your Personal Information, either temporarily or permanently. You may also request that we stop selling or sharing your Personal Information.


* Right to Withdraw Consent: You also have the right to withdraw your previously granted permission to process your Personal Information or to object to the processing of your Personal Information by Va Beau.


* Right to Non-Discrimination: We will not discriminate against you for exercising of your rights.


* Opt-Out of Sale. You can request to opt out of the sale of your Personal Information to a third party.


* Opt-Out of Targeted Advertising.  To the extent allowed by law, you can request that we stop using your Personal Information for targeted advertising by clicking on the “Cookie consent” link that may be in the footer of our Platform. Additionally, you can opt out of certain uses of cookies for advertising purposes by visiting http://www.aboutads.info/choices. Your opt-out of cookie-based tracking for advertising purposes is specific to the device, website, and browser you are using; it is deleted whenever you clear your cookies or your browser’s cache.


Our Policy on “Do Not Track” Signals. Some internet browsers may be configured to send “Do Not Track” signals to the online services you visit. We currently do not respond to “Do Not Track” or similar signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

13. Rights of European Residents


If you are from the European Economic Area (EEA), you have the following rights concerning your Personal Information. If you wish to be informed what Personal Information we hold about you and if you want it to be removed from our systems, please contact us.

* The Right to Access, Update or to Delete. Whenever possible, you can access, update, or request deletion of your Personal Information directly within your account settings section. If you cannot perform these actions yourself, please contact us to help you.


* The Right of Rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.


* The Right to Object. You have the right to object to our processing of your Personal Information.


* The Right of Restriction. You have the right to request that we restrict the processing of your Personal Information.


* The Right to Data Portability. You have the right to receive a copy of the information we have about you in a structured, machine-readable, and commonly used format.


* The Right to Withdraw Consent. You also have the right to withdraw your consent at any time where we relied on your consent to process your Personal Information.


We may ask you to verify your identity before responding to such requests. You also have the right to complain to a Data Protection Authority about our collection and use of your Personal Information. For more information, please contact your local data protection authority in the European Economic Area (EEA).

You will not usually have to pay a fee to access your Personal Information (or to exercise the other rights described in this Privacy Policy). However, we may charge a reasonable fee if your request is unfounded, repetitive, or excessive.

We may need to ask for specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). To the extent you use a third party to submit a data request on your behalf, we may need to take reasonable steps to verify the authenticity of the request. These are security measures to make sure Personal Information is not disclosed to any person with no right to receive it. To speed up our response, we may also contact you to ask you for further information in relation to your request.

15. Children’s Privacy


The content and services provided by us or our affiliates, sponsors, and advertisers, including without limitation the Platform, are not intended for anyone under the age of 18 and you should not access such content or services if you are under the age of 18. No information is knowingly collected or kept from children under the age of 13, nor is any such information knowingly used for any marketing or promotional purposes, either inside or outside the Platform. No part of the Platform is designed to attract anyone under the age of 13. Children are not eligible to use any services provided by us and we ask that children under the age of 13 not submit any Personal Information to us.

If you are a parent or guardian and believe your child has uploaded Personal Information to our Platform without your consent, you may contact us at care@vabeau.com. If we learn a child has provided us with Personal Information in violation of applicable law, we will delete any Personal Information we have collected, unless we have a legal obligation to keep it.
